The goods ordered in the PINK TURNS BLUE - Shop will be delivered under the General Standards and Terms below (Date: 02/2004):

1. Order / Conclusion of a Contract

The goods offered in the PINK TURNS BLUE - Shop can be ordered via the Internet. The contract for sale between PINK TURNS BLUE (PINK TURNS BLUE - Shop) and the customer comes to being with the acknowledgement of order by PINK TURNS BLUE, at the latest with the delivery of the goods.

2. Delivery

The delivery will be executed worldwide to the given address. Generally, the goods will be delivered within 14 days after the reception of the monies in our bank account. Because of weekends, holidays and possible non-availability the time of delivery can be longer. In case we can't delivery or can't deliver in time you will be informed by us via email.

3. Reservation of ownership

The goods are owned by PINK TURNS BLUE until they are paid.

4. Terms of payment, Package and Postage

All prices are in EUR and contain the local taxes of currently 16 % resp. 7 % (for tickets). You can pay the ordered goods by bank transfer. Per order we will charge you 3,00 EUR within Germany, 3,00 EUR within the European Community and 5,00 EUR worldwide for packaging and postage. Generally, your order will be sent to you in one packet. If goods need to be packed and sent seperately because of different sizes etc., part shipment is possible. Ther will be no surcharge for part shipment.

5. Right to Revoke

You can revoke your order with 14 days after your initial order. As oberservance of deadline it is sufficient to send us your wish to revoke via email (shop [at] pinkturnsblue [dot] com) or via post to the address below and/or return the goods in good order, unused and in original and packed condition. Please note that your to revoke ceases the moment open or break the packaging of our software Audio- or Videoproducts (CDs/DVDs). This is also the case if you damage the goods.

The costs for returning the goods has to be paid by you unless the goods are not the ones you have ordered. We cannot not accept returned goods with postage not prepaid. Monies already paid to us will be refunded after the goods have been correctly returned.

An impairment of value (visible signs of usage) caused by use during the revokement period has to be paid by you. The difference will deducted from the refund. You can avoid this deduction by making use of the goods after the revokement period.

6. Warranty

Your right of revokement within 14 days after the reception of goods does not infringe your legal rights as customer concerning warranty. In case a good bought from us is faulty, you have 2 years to claim your warranty rights. Please keep the invoice in a safe place. A warranty for the qulaity of goods can only be given if confirmed expressively, seperately and in writing. In case the goods have obvious defects, especially in material, manufacturing or because of transport, please announce these defects at once. In case of defects that come from transport, get a signed confirmation by the carrier. Otherwise the law of warranty applies.

7. Liability

Claims apart from warranty claims, especially claim for damages are excluded unless the damage was caused by PINK TURNS BLUE deliberately or grossly negligent or breach of contract. PINK TURNS BLUE - unless willfully - will not be held liable for unforeseeable damages. These exclusions are not applicable for guarantees in writing, malicious silence with regard to a defect, in case of damage to life, body or health or in case of product liability laws.

8. Data Privacy Protection

The data needed for perform the contract will be stored and treated strictly confidential. We ensure to use the data for our internal purposes only. We will not give data to third parties. We might need to give the data to third parties for credit investigation (only needed fro credit card transaction, cash on delivery or invoice). Obviously you can object to this use any time. 9. Other

In case one or several rules of this GENERAL STANDARD TERMS AND CONDITIONS are invalid, the other rules still apply. Place of fulfillment and jurisdiction is Berlin, Germany. Even for orders from outside Germany German laws apply under exclusion of the international private law and the UN-purchase right.
